Charter Amendment Process

Del Rio is a “Home Rule” city governed by a City Charter. A city charter is the constitution governing the municipal government. The charter defines the powers the citizens agree to give their city government and how the government is to be structured. The charter defines which officials are elected, their term lengths, duties, powers and responsibilities and establishes the lines of authority for the departments.

The charter is reviewed periodically to ensure that it continues to provide reliable guidance on the relationship between the structure of the city government and performance; and that the structure will achieve the goals of efficiency, effectiveness, and equity. The Charter Review Committee oversees the amendment process.

Ballot Language


The City of Del Rio is proposing amendments to the City Charter. These proposed amendments were selected after several public meetings were held by the Charter Review Committee. The Committee, comprised of members of the public, worked with City staff and City Council to review and make recommendations on the amendments and these will be taken to the voters of Del Rio during the May 2014 City elections.

PROPOSITION NO. 1 – (Proposición No. 1)


FOR / AGAINST The amendment of the City Charter creating a process to disannex property
of the City as required by State law.
PARA / CONTRA (La enmienda de la carta de la ciudad creando un proceso de disannex propiedad
de la ciudad como es requerido por la ley estatal.)

PROPOSITION NO. 2 – (Proposición No. 2)


FOR / AGAINST The amendment of the City Charter to be effective changing the term of office for Mayor from two (2) years to four (4) years and the limitation on consecutive terms for the office of Mayor from four (4) consecutive terms to two (2) consecutive terms.
PARA /CONTRA (La enmienda de la Constitución de la ciudad para ser eficaz, cambiando el término de oficina para Alcalde de dos (2) años a cuatro (4) años y la limitación de consecutivos términos para el cargo de alcalde de cuatro (4) mandatos consecutivos a dos (2) términos consecutivos.)

PROPOSITION NO. 4 - (Proposición No. 4)


FOR / AGAINST The amendment of the City Charter adjusting for inflation the maximum amount of pay for City Council and the Mayor from $100.00 to $250.00.
PARA /CONTRA (La enmienda de la Constitución de la ciudad la cantidad máxima de ajuste por inflación de retribución por un Concejo Municipal y el Alcalde de $100.00 a $250.00.)

PROPOSITION NO. 5 - (Proposición No. 5)


FOR / AGAINST The amendment of various City Charter sections to establish consistency and compliance with State law.
PARA / CONTRA (La modificación de varias secciones de la Constitución de la ciudad para establecer la consistencia y cumplimiento con las leyes estatales.)

Proposed City Charter amendments, changes, and removals:

Remove Section 21 regarding annual audits because state law sets these requirements and supercedes local rules.

Change Section 39 to remove local requirements for filling vacant seats

Change Section 40 to remove general local election rules

Remove Section 41 regarding election canvassing. All three of these sections are superseded by state election law.

Change Section 59 regarding the enactment of the fiscal year’s budget where inconsistent with state law.

Remove Section 76 regarding competitive bidding as superseded by state law.

Amend Section 77 regarding public works contracts by stating only that the city’s procedures follow applicable state law.

Change Sections 93 and 95 regarding elections for, issuing, execution and registration of bonds in order to follow state law.

Amend Section 104 on initiatives and Section 111 regarding recall elections in order to follow the state uniform election code.

Amend Section 75 regarding the sale of personal property to follow state law that requires open competition by removing the monetary threshold for triggering the requirement.

PROPOSITION NO. 6 - (Proposición No. 6)


FOR / AGAINST The amendment of the City Charter to require initiative petitions be signed by five percent (5%) of the number of qualified voters registered to vote at the last general election.
PARA / CONTRA (La enmienda de la Constitución de la ciudad para exigir peticiones de iniciativa firmada por cinco por ciento (5%) del número de los votantes elegibles registrados para votar en la última elecciones generales.)

PROPOSITION NO. 7 - (Proposición No. 7)


FOR / AGAINST The amendment of the City Charter to require referendum petitions be signed by five percent (5%) of the number of qualified voters registered to vote at the last general election.
PARA/ CONTRA (La enmienda de la Constitución de la ciudad para exigir peticiones de referéndum será firmado por el cinco por ciento (5%) del número de los votantes elegibles registrados para votar en la última elecciones generales.)

PROPOSITION NO. 8 - (Proposición No. 8)


FOR / AGAINST The amendment of the City Charter to require five percent (5%) of all gross income generated by the bridge be placed in a separate financial to pay for the maintenance of the existing bridge, for the construction of a second bridge, or upon a two-thirds vote of City Council on Capital improvements with the City or the City’s ETJ.
PARA / CONTRA (La enmienda de la Constitución de la ciudad para exigir el cinco por ciento (5%) de los ingresos brutos generados por el puente de colocarse en un separado financiera para pagar el mantenimiento del puente existente, para la
construcción de un segundo puente, o tras una votación de dos tercios del Concejo Municipal sobre las mejoras de Capital con la ciudad o la ciudad ETJ.)

PROPOSITION NO. 9 - (Proposición No. 9)


FOR / AGAINST The amendment of the City Charter requiring members of the City Council and elective and appointive officers of the City to comply with State conflicts of interest law in matters involving a franchisee of the City.
PARA / CONTRA (La enmienda de la Constitución de la ciudad que requieren los miembros del Concejo Municipal y electivos y nombrados oficiales de la ciudad para cumplir con los conflictos del estado de Ley de interés en asuntos relacionados con una
franquicia de la ciudad.)

PROPOSITION NO. 10 - (Proposición No. 10)


FOR / AGAINST The amendment of the City Charter providing for an interim government in the case of a natural disaster.
